Romeo’s Rewards Terms and Conditions

 

1. Terms

1.1. We own and operate the Program, being a loyalty program through which we provide member offers, deals, promotions and targeted communications.

1.2. These Terms contain the terms and conditions on which the Program is made available to you.

1.3. By setting up an Account, linking a Card to an Account as permitted under these Terms and/or by accessing and/or using the Program, you accept these Terms. Please read these Terms carefully. If you do not agree to these Terms, please do not set up an Account, link a Card to an Account or otherwise access or use the Program.

1.4. We may revise and amend these Terms from time to time. We will notify you where these Terms are revised and amended. Where you do not agree to any revision or amendment of these Terms, you may cancel your Account and/or otherwise cease using and accessing the Program. Your continued access and/or use of the Program after such changes will be deemed acceptance of such changes.

2. Membership

2.1. To participate in the Program, you must set up an Account. We do not charge a fee to set up an Account. You can set up an Account by:

2.1.1. downloading and following the relevant prompts on the Mobile Application; or

2.1.2. subject to clause 2.2, picking up a physical Card at any Romeo Store and submitting your details on the Website.

2.2. On and from 1 July 2026, we will no longer offer new physical Cards and the only way to set up an Account is through the Mobile Application. Notwithstanding the foregoing, any existing physical Cards may continue to be used in the Program unless we notify otherwise.

2.3. In order to set up an Account, you must meet the eligibility requirements we notify from time to time.

2.4. If you do not provide the information requested in the Account set up process, you may not be able to participate in the Program and/or your participation in the Program may be limited.

2.5. If you have a physical Card, you may download the Mobile Application and link your Account and Card on the Mobile Application.

2.6. When setting up an Account, you need to select the Romeo Store that will be your ‘home store’ (Home Store). The Mobile Application will provide you with information specific to your Home Store.

2.7. If your Home Store ceases to trade as a Romeo Store, then your Home Store will be updated to the closest Romeo Store to your former Home Store. You can update your Home Store through the Mobile Application from time to time.

2.8. Your Account is not transferable.

2.9. Your Card is not transferable and may only be used by the registered cardholder.

2.10. It is your responsibility to keep your personal details in respect of your Account updated.

2.11. If your personal details change and you fail to notify us of the change, we might not be able to offer or provide benefits to you and may need to cancel your Account and/or Card.

2.12. If a physical Card which is not linked to an Account is lost, any benefit loaded on that Card may not be capable of being replaced.

2.13. Parents/guardians can create an Account for persons under 18 years of age. However, some targeted offers and benefits are restricted to persons 18 years of age and older.

3. Participating stores

3.1. Romeo Stores that are participating in the Program will display the Romeo’s Rewards logo.  

3.2. Participating Romeo Stores will provide different benefits, and they will vary them from time to time. For example, some Romeo Stores will offer Romeo’s Rewards special prices on selected products. However, all Romeo Stores will award Romeo Rewards Points that you can use to pay for a future purchase. For details of what benefits a Romeo Store offers, check the Mobile Application or with the staff at your next visit.

4. Using your Card

4.1. Shop at any Romeo Store and get your Card swiped at the checkout before the transaction is finalised to earn Romeo Rewards Points.

4.2. Every dollar you spend earns you Romeo Rewards Points that can be collected and redeemed to reduce your Romeo Store grocery bill.

4.3. For each $2.00 you spend in a Romeo Store, we will attribute one (1) Romeo Rewards Point to your Account (or physical Card if it is not linked to an Account).

4.4. Romeo Rewards Points are calculated on each separate transaction you make at a Romeo Store.

4.5. You can redeem your saved Romeo Rewards Points at any given time at the commencement of a transaction at any Romeo Store.  

4.6. Romeo Rewards Points are not transferable or exchangeable for cash, except as provided under the Program.

5. Expiry of Romeo Rewards Points

5.1. All current and future Romeo Rewards Points will expire twelve (12) months from the date on which they were or are (as applicable) credited to your Account (or Card as applicable) unless redeemed earlier at a participating Romeo Store.

6. Excluded Products

6.1. Tobacco, gift cards and Epay will not qualify for Program discounts and savings, and will not be included in the calculation of qualifying spend or otherwise recognised for the purposes of offers or the accrual of Romeo Rewards Points.

6.2. Other products may be added to the above list of excluded products at our discretion. Lists of excluded products will be available in updated versions of these Terms, on the Mobile Application, the Website and/or in a Romeo Store.

7. How to cancel your Account

7.1. You may cancel your Account using the Mobile Application. If your Account or Card is cancelled, all associated benefits will be automatically forfeited.

8. Lost, Stolen or Damaged Cards

8.1. Physical Cards cannot be replaced. If your physical Card is lost, stolen or damaged, you will need to access your digital Card through the Mobile Application.

8.2. If your physical Card is not registered with an Account, any benefits already loaded on that lost or stolen Card may not be capable of being replaced or transferred.

8.3. If your physical Card is registered with an Account, any benefits already loaded on that lost or stolen Card may be capable of being transferred to a digital Card.

8.4. If you lose your device and you use a digital Card on that device, please contact us immediately so that we change the password on your Account to protect your details and accrued benefits in the Program.

9. Third Party Offers

9.1. To the extent the Program allows you to access third party offers, you may accept those offers by contacting the third party provider directly.

9.2. You are responsible for evaluating whether you want to access those third party offers and you should review any applicable terms or policies of that third party.

10. Privacy

10.1. All information that you provide through the Program including the Account set up process is governed by our Privacy Policy and we will take all reasonable steps to prevent any data being inappropriately released or misused.

10.2. You acknowledge and agree that:

10.2.1. through the use of the Program, Personal Information about you will be collected and used by us or our related third parties or service providers;

10.2.2. all Personal Information that we collect is subject to our Privacy Policy; and

10.2.3. our Privacy Policy is deemed to be incorporated into these Terms and our collection, use and sharing of all personal information will be as set forth in our Privacy Policy.

11. WorldSmart and GaP

11.1. The Program is hosted and/or otherwise managed by WorldSmart and/or GaP, being third party service providers.

11.2. In hosting and/or otherwise managing the Program, WorldSmart and/or GaP will collect and/or otherwise receive Personal Information from you.  The nature and extent of Personal Information that WorldSmart and/or GaP collects and/or otherwise receives varies depending on the level of your interaction with the Program. 

11.3. The types of Personal Information that WorldSmart and/or GaP may collect and/or otherwise receive about you include (but is not limited to) name, contact details, date of birth, supermarket transaction details, points accrual and reward details and authorisations.

11.4. WorldSmart and/or GaP collects and/or otherwise receives Personal Information about you from the following sources:

11.4.1. direct from you when you set up an Account;

11.4.2. the Romeo Store when you use your Card; and

11.4.3. the point of sale system and software installed and operated when you use your Card.

11.5. WorldSmart and/or GaP collects and/or otherwise receives and handles your Personal Information for the purpose of hosting, maintaining, improving and personalising the Program (Primary Purpose).  The Primary Purpose includes the following functions and activities:

11.5.1. delivering products and services requested by you, us, your Home Store and other participating stores (if any);

11.5.2. providing you with further information about the products, services, benefits and promotions available under the Program;

11.5.3. managing the program benefits for your Card by reference to your eligible purchases;

11.5.4. to personalise and customise your experiences with the Program;

11.5.5. to verify your identity;

11.5.6. to maintain and update records relating to the Program and your membership of the Program; and

11.5.7. to deal with your enquiries relating to the Program and enquiries made by your Home Store or us.

11.6. You consent to us, your Home Store, WorldSmart and GaP collaborating and sharing your Personal Information for the Primary Purpose.

11.7. In hosting and managing the Program, WorldSmart and/or GaP may need to disclose personal information to third parties including:

11.7.1. third party contractors engaged to provide technical services;

11.7.2. professional advisors, including accountants, auditors and lawyers;

11.7.3. persons authorised by you; and

11.7.4. any persons as required or permitted by any law.

12. Liability

12.1. While we own the Program, we have third parties that help us operate it and selected businesses and organisations (such as Romeo Stores) that we may promote through the Program.

12.2. You acknowledge that we and our related bodies corporate, Romeo Stores and our third party service providers (such as GAP and WorldSmart) (Relevant Persons) will handle your data.

12.3. To the maximum extent permitted by applicable law, you agree that we and the Relevant Persons will not be liable to you for and you release the Relevant Persons from any loss, damage, cost or expense you may suffer:

12.3.1. due to events beyond the reasonable control of the Relevant Persons;

12.3.2. in connection with the Program, except to the extent a Relevant Person has caused or contributed to such loss, damage, cost or expense through its negligent acts or wilful misconduct; or

12.3.3. as a result of the suspension, non-availability or termination of the Program or your Account.

12.4. In no circumstances will we or the Relevant Persons be liable to you or any other person for any amount for any economic, consequential, contingent, special or indirect damages, or loss of business, revenue or profit with respect to claims arising in connection to the Program or your participation with the same or for a breach of contract or laws, negligence or under any other theory of law including where we were aware or had been told of the possibility of any such damage or loss.

12.5. Without limiting clause 12.4, our and the Relevant Persons maximum aggregate liability to you in respect of all claims, liability or costs arising from any of our acts or omissions, breach of contract or laws, or for negligence or under any other theory of law is limited to $1.00.

12.6. We hold the rights in favour of the Relevant Persons under this clause 12 on trust and for the benefit of the Relevant Persons.

13. Other Matters

13.1. We reserve the right at any time and without notice, to modify or terminate the Program.

13.2. We are not responsible if you are unable to access or receive Program benefits as a result of your failure to comply with these Terms, including a failure to provide accurate details or update your details in your Account.

13.3. We may (i) decline to register your Account and/or issue you a Card; or (ii) where we reasonably believe it is necessary to protect your or our interests, withdraw, suspend or cancel your Accounts and/or Card, in whatever form, and remove you from the Program or remove Program benefits (at any time) if we reasonably believe that you:

13.3.1. are abusing or attempting to abuse the Program;

13.3.2. have materially breached these Terms; or

13.3.3. are involved in any behaviour relating to the Program that involves theft, fraud, misconduct, abusive, offensive or other inappropriate behaviour, or the supply of false or misleading information.

13.4. All disputes concerning the Program will be referred to the Romeo Retail Group’s National Marketing Manager. If the dispute cannot be resolved to the satisfaction of either party, the dispute will be referred to one of our directors for resolution.

14. General

14.1. We may give you notice by email, post, on the Mobile Application or by contacting you on your supplied contact details. You may give us notice by contacting us on rewards@romeosretail.com.au.

14.2. These Terms are not to be interpreted against us merely because they were prepared by us.

14.3. We will not be liable for any failure to perform our obligations to the extent and for so long as our performance is prevented or delayed because of circumstances outside of our direct control (including labour disputes, obtaining labour, destruction or damage to our premises or a relevant supply site, default or insolvency of any third party, an act of government or governmental authority, terrorism, disruption to the supply of power, gas, internet, water, electronic or telecommunication services, civil disorder, the weather or other natural events) and without fault or negligence by us.

14.4. You cannot assign or transfer rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in our absolute discretion.

14.5. We can only waive any of our rights under these Terms in writing.

14.6. These Terms are governed by South Australia law and the parties submit to the non-exclusive jurisdiction of South Australia courts in respect of any disputes arising under or in connection with these Terms.

14.7. We are entitled to bring proceedings in any court in any jurisdiction in which you are located or where, acting reasonably, we consider such court provides the most efficient or convenient means for us to enforce these Terms and our rights under the same.

15. Interpretation

15.1. In these Terms:

15.1.1. Account means your account in respect of the Program.

15.1.2. Card means the “Romeo’s Rewards Card” issued in connection with the Program which may be (i) a digital card accessible through the Mobile Application; or (ii), subject to clause 2.2, a physical card which we supply to you.

15.1.3. GaP means GaP Solutions Pty Ltd (ACN 057 892 538).

15.1.4. Home Store has the meaning given in clause 2.6.

15.1.5. Mobile Application means the software application known as “Romeo’s Rewards App”.

15.1.6. Personal Information means information (including an opinion) about an individual whose identity is apparent or can reasonably be ascertained from the information whether true or not and whether or not recorded in a material form

15.1.7. Privacy Policy means the privacy policy published by us (as updated and replaced from time to time) and which is available via www.romeosretailgroup.com.au.

15.1.8. Program means the customer loyalty program known as “Romeo’s Rewards”.

15.1.9. Romeo Rewards Points means points you accrue by participating in the Program as specified in these Terms.

15.1.10. Romeo Store means any store trading under the “Romeo” or “Romeo Retail Group” name which is participating in the Program.

15.1.11. Terms means these Terms and Conditions.

15.1.12. we, our or us means Kensington Park Investments Pty Ltd (ACN 127 318 512).

15.1.13. Website means the website located at romeosrewards.com.au.

15.1.14. WorldSmart means Worldsmart Retech Pty Ltd (ACN 107 563 511).

15.1.15. you means the person who sets up an Account or links a Card to an Account as permitted under these Terms and any other person that accesses and/or uses the Program.

15.2. In these Terms:

15.2.1. singular includes plural and vice versa;

15.2.2. reference to a person includes a body politic or corporate, an individual and a partnership and vice versa;

15.2.3. a reference to us in respect of any limit of liability in these Terms is deemed to include our employees, directors and officers;

15.2.4. no rule of construction applies to our disadvantage because we put forward these Terms; and

15.2.5. if a provision in these Terms would, but for this clause, be unenforceable (i) the provision must be read down to the extent necessary to avoid that result; and (ii) if the provision cannot be read down to that extent, it must be severed without affecting the validity and enforceability of the remainder of these Terms.
